Consumers

Under the Consumer Guarantees Act 1993 ('CGA'), you have guaranteed legal rights for goods [and services] you buy.

These are called 'consumer guarantees', and include the following:

  1. a guarantee that the goods are of acceptable quality, such that the goods are:
    • fit for all the purposes for which goods of that type are commonly supplied;
    • free from minor defects;
    • safe
    • durable; and
    • acceptable in appearance and finish;
  2. a guarantee that the goods are fit for any particular purpose made known by you, or for which we represent that they are or will be fit;
  3. a guarantee that the goods correspond with any description with which the goods are supplied; and
  4. a guarantee that the goods correspond with any sample or demonstration model where the goods are supplied by reference to such sample or model.

If the goods (or servicesāˆ„ we supply do not meet a consumer guarantee, we will meet our obligations under the CGA to provide a remedy.

These guarantees are in addition to any warranty offered by a manufacturer, and you may have rights against the manufacturer directly.

The CGA does not apply where the goods have been used in a manner, or to an extent which is inconsistent with the manner or extent of use that a reasonable consumer would expect to obtain from the goods; and the goods would have complied with the guarantee of acceptable quality if they had not been used in the manner or to that extent.

Where you have an issue relating to your order, please immediately contact the Big Brands store that supplied the goods to you. Please have your order details with you.

 

Refund Policy

Refunds will be issued at the discretion of Big Brands.

Please note that goods must be returned within a reasonable period and you may be asked to demonstrate that you have purchased the goods from Bigbrands.net.nz and that the problem with the goods was not your fault. 

We do not provide refund unless:

A. Not of merchantable quality;
B. Do not match the sample. (Colour variation excluded cannot be controlled)

You should return your goods within a reasonable time if A-C above occurs and provide Us with:

  • Proof of purchase by producing the original Tax Invoice. Your Tax Invoice will be provided on dispatch from a Store.
  • The Goods listed on the Tax Invoice with all original packaging and manuals enclosed (including any Bonus Offers)
  • Suitable ID to identify you as the original purchaser; and
  • Details of the fault or issue with the product and that the fault or issue was not caused by you.

All refunds must be refunded via Support Centre Payment Request Form. Credit Card or PayPal funds will then be refunded back to the customer’s account by Support Centre This may take up to 7 business days to occur. Subject to the Act non-returnable Items include, but are not limited to:

  • Store Credit
  • Digital content
  • Items that are severely damaged or abused
  • Where the unique product serial number has been obscured, defaced, removed or does not match records of stock carried at Bigbrands.net.nz
  • Items that are missing accessories.
  • Etched or otherwise personalized items

If a Product is damaged on delivery, then you should refuse to take receipt of that Product and notify Us immediately.

You will be liable for any costs incurred relating to delivery or installation, where the Products have been delivered to you, unless the product is found to be faulty or damaged.

You must also return any Bonus Offers included with your original purchase in an “as new” order with all original packaging and manuals enclosed to receive a full refund.

 

Disclaimers and Limitation of Liability

By using the Site, you expressly agree that use of the Site is at your sole risk.

To the full extent permitted by law, We exclude all liability in respect of loss of data, interruption of business or any consequential or incidental damages.

To the full extent permitted by law, We exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.

These Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions or obligations. If such legislation applies, to the extent possible, We limit Our liability in respect of any claim to, at Our option:(a) in the case of goods:

(i) the replacement of the goods or the supply of equivalent goods;
(ii) the repair of the goods;
(iii) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
(iv) the payment of having the goods repaired; and
(b) in case of services:
(i) the supply of the services again; or
(ii) the payment of the cost of having the services supplied again.

We and Our affiliates, subsidiaries or designees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, "Associates") warrant that use of the Site will be uninterrupted or error-free.

We do not warrant the accuracy, integrity or completeness of the content provided on the Site or the products or services offered for sale on the Site.

No oral advice or written information given by Us shall create a warranty.

We are not liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use the Site, including but not limited to reliance by you on any information obtained from the Site that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance.

The foregoing Limitation of Liability shall apply in any action, whether in contract, tort or any other claim, even if We have been advised of or should have knowledge of the possibility of such damages.

You hereby acknowledge that this paragraph shall apply to all content, merchandise and services available through the Site.

Should We suffer any damage as a result of a transaction entered into by a minor, compensation can be sought from parents or legal guardians of the minor.

Warranties

You represent and warrant to Us that:
(a) you have the legal capacity to enter these Terms; and
(b) you will not add any content whatsoever to this Site except information that is requested of you

(c)All warranties are manufactures structural warranties. If installation required it must be installed by a certified installer and installed to New Zealand standards  

  (d) If warranties is applicable, Please email sales@bigbrands.net.nz with sufficient evidence to support your claim.  Please include details of certified installer.  

 

Things to be considered

(e)Fade resistance: Although majority of our products are fade resistant,fading degrees may depend on individual lacation

(f)Moisture resistant Products are resistant to general spills , spills should be cleaned up immediately, moisture resistant product are not water proof,we recommend floors to be installed according to New Zealand standards,floors are to be cleaned with a static micro fiber dry mop
